The New Country 95.7 Feel Good FREEbies Program is designed to be a fun and very rewarding experience for our most loyal listeners. Literally thousands of fabulous prizes will be available to win in 2008.

To prevent Program abuse, the following Program rules and regulations will be strictly enforced to ensure that ALL Program participants are competing fairly.  Please be advised that it is in your best interest that you both read and comprehend these program rules completely.

30-day Rule:

There currently is no "30-day rule" in effect with respect to how often you can claim a prize in the New Country 95.7 (KUSS-FM) Feel Good FREEbies Program. This is subject to change; however, you will receive plenty of advance notice before (if and when) this change would go into effect.

Account Limits:

New Country 95.7 (KUSS-FM) Feel Good FREEbies Program accounts are expressly limited to ONE ACCOUNT PER PERSON; TWO ACCOUNTS PER HOUSEHOLD. A "household" constitutes two INDIVIDUAL people participating INDEPENDENTLY in the Program by gathering and entering information into their OWN respective account. This is an INDIVIDUAL effort, not a team effort. If the same person is determined to either have registered and/or have been playing under two or more accounts, ALL accounts in question will be terminated immediately (without notification) and individual will be banned permanently from participation in this program. If more than two accounts have registered in one household, ALL of said accounts are subject to termination (without notification).

Account Profile Information:

Your (exact) HOME address must be used when registering in the New Country 95.7 (KUSS-FM) Feel Good FREEbies Program. ALL information provided upon registration must be complete and accurate. If false and/or inaccurate information is determined, your account is subject to termination (without notification). To update/correct your account information, click on My Account/Edit My Info.

Bidding on "Auctions"/Related Accounts:

In fairness to all participants, related accounts may not participate in bidding on the same individual New Country 95.7 (KUSS-FM) Feel Good FREEbies "Auction" items as this does not reflect independent activity. If two related accounts are determined to have placed a bid on the same "Auction" item, whichever account registered in the New Country 95.7 (KUSS-FM) Feel Good FREEbies Program last will be terminated (without notification).

Code Cards:

The deadline for entering code card number(s) to earn event/appearance-related points is always clearly stated on the respective points promotion description web page (under "Sponsor Codes").  New Country 95.7 (KUSS-FM) always allows adequate time after each event to enter the code card number(s). If the code card number(s) is not entered by the specified deadline, no points will be earned for that event/appearance.

For non event/appearance-related code cards picked up at Sponsor locations, the deadline to enter the code(s) is within 72 hours. We cannot be responsible if you wait longer than 72 hours - the code will no longer be valid.

Entering Information in More Than One Account:

In fairness to all participants in the New Country 95.7 (KUSS-FM) Feel Good FREEbies Program, anyone determined to be playing under two or more e-mail addresses or entering ANY information in an account other than their own will have ALL related accounts terminated immediately (without notification). This rule is in effect to ensure that all participants are competing on an equal playing field and to eliminate the possibility of an unfair advantage by individual participants. New Country 95.7 (KUSS-FM) has a zero tolerance policy when it comes to participants taking advantage of this Program in order to increase the number of prizes that you can win - PLEASE play fairly, the rewards are amazing.  You cannot register/sign-up any participant other than yourself in this Program.  If a New Country 95.7 (KUSS-FM) Feel Good FREEbies Program member has a proven medical disability, that person's caregiver may in certain instances be authorized by New Country 95.7 (KUSS-FM) to enter information on their behalf.  In such event, the caregiver must first send New Country 95.7 (KUSS-FM) a letter explaining the medical disability and requesting approval to enter data on behalf of such person.  New Country 95.7(KUSS-FM) will then notify the caregiver and the medically disabled person if the entering of data on the disabled person's behalf is approved or if more information documenting the disability is needed. Letters requesting approval for entering information on behalf of a medically disabled person should be sent to the attention of:  Mary Deary, New Country 95.7 (KUSS-FM), 9660 Granite Ridge Drive, Suite 100, San Diego, CA 92123.

Expiration of Feel Good FREEbies Accounts:

Any New Country 95.7 (KUSS-FM) Feel Good FREEbies Program accounts with no activity for a period of 30 days or longer may be subject to termination without notification and all accrued points will be forfeited. If for whatever reason you cannot access your account for a 30-day period, please let us know in advance and we will make the necessary notations on your account.

Expiration of Feel Good FREEbies Points:

All New Country 95.7 (KUSS-FM) Feel Good FREEbies Program accumulated points that were accrued in 2006/2007/2008 that have not been spent by 12/31/08 will carryover to 2009.  In 2009, the status of this rule will be re-evaluated and is subject to change.  At least six months notice will be given in the event of a change.
 

General Program Rules:

     o must be at least 18 years of age or older

     o must reside in KUSS-FM's Total Survey Area (TSA*)

     o must have internet access to participate

     o must have a valid e-mail address

     o must be fairly computer literate in order to participate - someone else may not enter information on your behalf

* Total Survey Area Definition:  All of San Diego County and the following cities (zip codes) in Riverside County:  Anza (92539), Murrieta (92562 and 92563) Temecula (92589, 92590, 92591, 92952) and Wildomar (92595).

 Mirrored Account Activity/Similar Pattern of Activity:

EVERY points transaction is logged - ANY RELATED ACCOUNTS WITH MIRRORED ACTIVITY (activity occurring within an hour or less of each other on two or more accounts over an extended period of time OR a similar pattern of activity over an extended period of time) will be terminated immediately (without notification) and member(s) will be banned permanently from participating in this Program. Mirrored activity suggests that the same person is entering information into more than one account.  ANY TYPE OF MIRRORED ACTIVITY BETWEEN RELATED ACCOUNTS IS STRICTLY PROHIBITED.

Points Events/Appearances:

You must arrive at any pre-determined points-designated events and/or appearances within the specified time period in order to earn points - there are NO exceptions.

Prize Pick-up:

Please allow 3 business days after winning prize to claim it (unless other arrangements have been made in advance or the prize is date sensitive). ALL New Country 95.7 (KUSS-FM) Feel Good FREEbies Program prizes must be claimed by the individual who won them – there are NO exceptions. Prizes must be picked up at the New Country 95.7 offices located at:  9660 Granite Ridge Drive, Suite 100, San Diego, CA  92123.  Our office hours are: Monday – Friday: 8:30AM – 5:30PM. You must present valid photo identification (i.e.: driver's license) to claim your prize. Your name, address and date of birth (including birth year) must match your New Country 95.7 (KUSS-FM) Feel Good FREEbies Program account record (exactly) or the prize will be forfeited.

No New Country 95.7 (KUSS-FM) Feel Good FREEbies prizes will be mailed.

Redeeming Points:

There are three ways in which to redeem your earned points:

     o Auctions: use your accumulated points to bid on items (eBay-style)

     o Raffles: use your accumulated points to purchase "chances" to win a specific prize - the more "chances" that you buy, the greater your odds of winning

     o Trade-Ins: use your accumulated points to "purchase" an item outright

Once you have redeemed your points for a specific prize, the prize is yours and cannot be returned for any reason.

Refer A Friend:

We encourage you to refer your friends and family to join the New Country 95.7 (KUSS-FM) Feel Good FREEbies Program.  However, any misuse of this point-earning component may result in the termination of all account(s) involved.

Sharing of Codes:

Sharing of ANY point-earning information amongst other New Country 95.7 (KUSS-FM) Feel Good FREEbies Program members is expressly prohibited and will result in the immediate termination of all account(s) involved (including any related accounts and/or any additional account that is registered in the household) as well as the forfeiture of all points accrued.

This includes, but is not limited to, the posting and/or retrieval of codes or ANY point-earning information on ANY online public forum.

Sponsor Codes:

All points received through various sponsors must be earned by each respective member themselves - there are no exceptions. Someone else may not pick up a code card at any station event/appearance. If this is determined to have occurred, the points received from the Sponsor in question will be deducted from your account and, in some cases, your account may be subject to termination (without notification).

Taxes:

In accordance with federal IRS regulations, Participant is solely responsible for any and all taxes which may be payable due to the receipt of a Prize, and shall authorize the Station to withhold any amounts required to be withheld pursuant to federal, state or local law. Participant will be required to complete a W-9 form if the total value of all prizes won through KUSS-FM/Clear Channel San Diego in a calendar year totals more than $600.00. If cumulative prize winnings total more than $600.00 in one calendar year, Participant will receive a 1099 form from Station/Clear Channel San Diego.

Technical Difficulties:

Disclaimer:  Please be advised that New Country 95.7 (KUSS-FM) is not responsible for errors affecting the Feel Good FREEbies reward system and its users which are caused by hardware and/or software failures at any point along the data transmission between the NewCountry957.com server computer and the end user terminal.

New Country 95.7 (KUSS-FM) is also NOT responsible for Program participants missing out on points due to:

     o updates, maintenance or heavy traffic to the Feel Good FREEbies Program website that may affect the Feel Good FREEbies Program usability at any particular time

     o Internet, browser, server or computer problems in general

In the event of inability to earn rewards resulting from specific incompatibility between individual end user machines and the Feel Good FREEbies reward system, New Country 95.7 (KUSS-FM) will attempt to the best of our ability to troubleshoot the issue; however, due to differences in software, hardware, internet providers and innumerable other factors – New Country 95.7 (KUSS-FM) cannot guarantee the ability of any given machine to be compatible with the Feel Good FREEbies Program and will not be responsible for the inability of game play on any individual machine and accordingly will not manage points for users whose machines are not compatible with the Feel Good FREEbies Program for any reason.

In summary, no manual point adjustments will be made due to technical difficulties.
